One day on a job at at someones house while he was running some wires, he fell through the ceiling into the living room. The damage was about ,200 to the house. My friends boss is demanding the ,200 from him and actually attempted to take my friends personal work tools until he paid the money to him.</p>
<p>What are the legal ramifications of this situation? </p>
<p>On a side note my friend is considering paying the money so he can keep is job and getting on with his life.</p>

I wanted to ask this Question:<br />
I live in Washington State. I am a contractor (not general CT). I work at a Call Center. I get paid by a Company in Lets say New Jersey as a Contractor. I was interviewed for a company lets call them T&#8230;.<br />
T Said I was a Good Fit.  My Contractor Said I would be Paid x amount of dollars per hour to Do said job for T for 2 years. Company T pays My Contractor who in turns pays me. We all know this. Been working at this company for 7 months Now&#8230;<br />
Ok so that&#8217;s the basics.<br />
Here is the problem&#8230; Company T&#8230; Is Now saying that my Job&#8230; Let’s call it Chewing Gum,<br />
Says That Chewing Gum is no longer necessary and they want me to rub my Stomach for the X amount of dollars now. Something completely different With a Completely different job Title.</p>
<p>Does this entitle me to renegotiate my Salary? I personally think it does&#8230; However that’s the reason for my question I need to know facts. </p>
<p>I have looked over my Contract it does not Say this&#8230; However it does say my Specific Job Functions are Chewing gum and that I will be paid to chew gum for X amount of Dollars.<br />
Also I googled it and could not find anything about Regular Contractors only &#8220;general Contractors, electricians and Plumbers.&#8221;<br />
I remember reading this some time in my life that if your a contractor and the actual Job changes and you get a different title and it&#8217;s Permanant that you contract has to be changed in order to show that your job actually changes. </p>
<p>Are there any paralegals’ or possibly any Attorneys Only Yahoo Answers who could answer this for me? Much appreciated or at least point me in the direction</p>
<p>Any Info would be Much appreciated.<br />
I have already Asked for more money As I&#8217;m underpayed for this position.<br />
With that being said. The Underlying Question is Does this mean they have to Provide me with a new Contract?<br />

			<content:encoded><![CDATA[<p>I am an electrical apprentice in the state of nebraska and work for an employer who classifies me as an independent contractor and uses form 1099-misc. I do not have contractor&#8217;s liability insurance or a business of my own &#8211; or any of the characteristics or qualifications of an independent contractor at all for that matter. I am not a licensed electrician yet, only an apprentice. I consider myself technically advanced and have recieved excellent training in the field, although, I know that I am not qualified to work independently. However, I am required to do just that by my employer. I run electrical service calls for exsisting homes and i&#8217;m trusted to complete each job from start to finish. Often, the service calls I run are for those who have an electrical hazard that has caused some sort of safety related issue in the home. I am required to diagnose, price and complete jobs like this almost weekly. Can I get in trouble for this? </p>
<p>I am told when and where to work and have all of the characteristics of an employee rather than an independent contractor. It is obvious that I would be considered an employee according to the IRS, however, is this legal? Am I liable for the work I am doing in these people&#8217;s homes? I am treated like an employee in every aspect but I believe in order to save money in taxes my employer has cheated the system. I was offered /hr more for electing to be 1099&#8242;d and told that it was perfectly legal and the best option for me. I don&#8217;t know much of anything about taxes outside of W2 forms. Was I tricked into: taking on liability of the work I do, being cheated out of employee rights and benefits, saving the company money in taxes and getting stuck paying more in taxes myself while the company I work for reaps the benefits of having control of my schedule and pay rate as if I were an employee?</p>

He has been working there for six months, and the owner came last week and made an list of tools required for the job.  There are 37 items listed on the list such as pipe wrenchs, Pump of Sprayer, Dust Pan with Broom, Crescent Wrenches (of all three sizes), Wood Chisel, Sledge Hammer, Wonder Bar, Hopper Gun and compressor (3H.P. Pancake), and the list goes on and on.  He wants my husband to sign it, and if he doesn&#8217;t have an item on the list he gets a .00 per hour deduction.  He distributed this to all the employees.  He even wanted him to have a multi-meter, and he isn&#8217;t even an electrician.  The guy has them doing electrical wire and plumbing yet no one is licensed (and my husband never indicated he was).  He was hired as a carpenter.  The list is far from what he considers &#8220;basic tools&#8221; so is this legal?  Can he fire my husband for not signing this<br />
It would probably cost about 00 dollars for everything on his list, and we barely make it on what he makes now.   We certainly do not have the extra money to buy these items.  He has some of the things on the list such as hammers, tool belts, screwdrivers, guns, squares, drills, tapes, and other things needed to remodel a home, but some of the items are related to different fields and things he never even uses.</p>

<p>How can they be &#8216;stealing jobs&#8217; when they are here LEGALLY and only doing the jobs that need filling? Can someone pls explain in ECONOMIC terms if they are actually stealing jobs if they are here LEGALLY?<br />
Isn&#8217;t just based on supply and demand of the labour market? In economic theory, can anybody claim that they &#8216;own&#8217; certain jobs in the labour market?</p>

Dreamwhip, the government is paying these workers less than the Australian citizens. But it is still LEGAL under the Industrial Relations law here.<br />
